Gubbii Creatives is a sole proprietorship based in Karnataka, India. The Site allows you to browse, select, and purchase hand-painted, appliquéd, and embroidered clothes and accessories for young kids ("Goods", "Products", or "Services").
This Agreement sets forth the terms and conditions that apply to your use of the Site. The right to use the Site is personal to you and is not transferable. You're responsible for protecting the confidentiality of your password(s). While it is our objective to make the Site accessible 24/7, the Site may be unavailable from time to time for any reason, including routine maintenance. We may change or discontinue any aspect or feature of the Site at any time.
By using the Site, you represent that you are of legal age to form a binding contract and are not barred from receiving services under applicable Indian law. You agree to provide true, accurate, current, and complete information about yourself. If any information you provide is untrue, inaccurate, or incomplete, we reserve the right to suspend or terminate your account.
You are responsible for maintaining the confidentiality of your account and password, and for all transactions made from your account — including use by family members, friends, or relatives. We strongly recommend logging out at the end of each session, and you agree to notify us immediately of any unauthorized use of your account.
We grant you a limited license to access and make personal use of the Site. This license does not permit downloading or copying account information for another vendor's benefit, unauthorized hypertext links or framing of Site content, uploading material containing viruses or harmful code, actions that impose an unreasonable load on our infrastructure, or use of data mining, robots, or similar extraction tools. Unauthorized use terminates the license granted to you.
You undertake that all goods ordered are for private and domestic use only, and are not for resale.
You must choose a username and password, and are responsible for all actions taken under them. Keep your password safe and don't disclose it to anyone; change it if you suspect it's been compromised. Do not transfer or sell your username, or permit anyone else to use your login. Please keep us informed of any changes to your details.
Using a false name or an invalid payment method to order is a crime, and deliberate fraudulent orders will be prosecuted to the fullest extent of the law. We reserve the right to end our agreement with you and suspend or terminate your access immediately if you breach these terms, fail to provide requested verification information, or if we suspect fraudulent or illegal activity, or use of our products for anything other than direct consumption.
If you breach these Terms, you will be responsible for costs and expenses we incur as a result, including reasonable legal fees. You remain liable if someone else uses your account or personal information, unless you can show such use was fraudulent.
If any of these conditions are deemed invalid or unenforceable, the remaining conditions remain valid and enforceable, and we will endeavour to give effect to the original intent of the provision.
These Terms govern our relationship with you. Any changes must be in writing and signed by both parties. Your statutory rights are not affected by these Terms, and nothing here limits our liability for fraudulent or negligent misrepresentation.
In no event shall Gubbii Creatives be liable for any special, incidental, indirect, or consequential damages of any kind in connection with this agreement, even if we have been informed in advance of the possibility of such damages.
